Our trial lawyers all began their legal careers clerking for trial court judges who demanded that we watch and learn from the leading trial advocates appearing in our courts.  We then began working as trial lawyers and started to try cases in short.  Indeed, Tom Barron had 25 jury trials within his first three years of practice.   Our lawyers realize that success in litigation requires much more than a confident courtroom manner and a rudimentary grasp of the rules of evidence.  It is essential that trial lawyers have a firm grasp of the law and our lawyers are constantly researching and reviewing the law to advance the interests of our clients. 

This appreciation for learning the law has become more important as the nature of civil litigation has changed.  Our trial lawyers devote substantially more time to legal research, briefing and writing.  We have developed an enviable reputation for the quality of our pleadings and submissions.  

We have also learned how to apply lessons learned in one area of law to different disciplines.  For example, in a case involving the loss of trade secrets, our lawyers applied criminal law presumptions to convince a court that a former employee was responsible for the theft of valuable customer files. Lessons learned in prosecuting and defending DWI cases later became helpful in developing scientific testimony in a wrongful death case.  Legal knowledge gained in a case against a manufacturer of animal feed was later used to defend a manufacturer of rust protection devices in a construction claims case.   Our knowledge of residential real estate practices has led to an expertise in consumer fraud litigation over defective homes and commercial structures.  

We rely heavily on client expertise to guide us about their cases.  We seek to create a collaborative relationship that educates and informs both the client and lawyer so that realistic judgments can be made as the case proceeds.

Our litigation philosophy is guided by a practical appreciation of our capabilities.  We have neither the desire nor resources to engage in legal wars of attrition.  Our approach is to develop a strategy that focuses of a central theory of recovery or defense and that exploits the opponent’s weaknesses and concerns.   We engage in focused discovery and seek to avoid the endless discovery disputes and motions that delay resolution of cases.

We also appreciate the roles of alternative dispute resolution and settlement in modern litigation. The most recent statistics show that less than two per cent of filed cases go to trial.  Our lawyers are court trained mediators and arbitrators who recognize the value, and limits, of these alternative methods of resolving cases.  We appreciate the different approaches and philosophies applied in alternative dispute resolution and can effectively guide our clients through the process.
