Criminal Defense

We at Barron, Baker & Posternock view the practice of criminal law as an important adjunct to our primary litigation and business practices. Although many shy away from criminal law, the stark reality is that many of our personal and business clients find themselves facing criminal investigations and prosecutions and need the services of a top notch criminal law litigator. On the other side of equation, it is important for the firm to use its hard earned capabilities in the criminal courts when there is a clear need for skilled and savvy practitioners who can avoid formal charges, negotiate favorable plea agreements and try tough cases to a successful conclusion. These considerations of client need and firm capabilities have resulted in our willingness to emphasize and promote our criminal law practice.

Let's talk about our capabilities. Tom Barron has been involved in the prosecution and defense of criminal defense matters since becoming admitted to the bar in 1975. He served as an Assistant Burlington County Prosecutor before going into private practice and he has tried over 40 felony cases to conclusion in state and federal court. He has tried homicide cases, multiple defendant drug conspiracy cases, and one of the few environmental prosecutions tried in the New Jersey state courts. Some of these trials took more than four months to complete so Tom is experienced in managing the "big case". In addition to his criminal practice, Tom's employment law and civil rights practices have given him exposure to police practices and procedures that provide additional insight on how to defend criminal matters. He also is experienced in the special issues that crop up in cases involving public employees and officials.

We are also familiar with representing clients and witnesses in grand jury proceedings, immunity issues, and the use of diversionary programs such as Pre-Trial Intervention and the Conditional Discharge Program. We have developed expertise in the area of domestic violence charges, which are often issued in conjunction with criminal charges.

Our involvement in civil litigation has helped us in creating unique approaches to criminal cases that often result in more favorable results for our clients. For example, we are more inclined to use motion practice to limit the evidence that prosecutors may use and narrow their arguments.

Because of our thorough approach to our cases, we normally are engaged with the same hourly fee and retainer basis that we use for civil litigation. However, there are cases where the results and efforts are fairly predictable and a flat fee billing arrangement may be appropriate.
